When a company faces evidence that a consumer product may be dangerous, US consumer-safety law does not primarily ask how well the company manages its reputation. It asks a much narrower question: did the company report the hazard information promptly to the regulator? What Reportable Hazard Information Is Meant to Trigger
The core reporting duty arises under Section 15(b) of the Consumer Product Safety Act. Manufacturers, importers, distributors, and retailers must notify the CPSC when they obtain information that reasonably supports the conclusion that a product violates a safety requirement, contains a defect that could create a substantial product hazard, or presents an unreasonable risk of serious injury or death. Importantly, the trigger is not a final determination that a product is definitely dangerous. The standard is lower. Why Internal Investigation Is Not a Public Answer
One of the most revealing features of the CPSC framework is its treatment of ongoing investigations. The Commission explicitly encourages companies to report potential substantial product hazards even while their own investigations continue.
