The limitation of this framing is that it can implicitly redefine the problem. Instead of asking whether the product creates an unacceptable risk under foreseeable conditions, the discussion becomes whether injured users perfectly followed every instruction.
From a product-safety perspective, foreseeable use is broader than intended use. A manufacturer may intend that a treadmill operate in a controlled exercise room. Yet if the product is marketed for homes, it is foreseeable that:
- Children may be present.
- Pets may wander nearby.
- Objects may fall or roll behind the machine.
- Users may become distracted.
- Household supervision may be imperfect.
The CPSC’s concern reflected this broader understanding of foreseeable conditions. The existence of warnings did not automatically resolve whether the machine’s design sufficiently reduced the risk when those predictable conditions occurred. For students of logical fallacies, this is the central lesson. When a safety concern involves foreseeable conditions, the relevant question is not simply whether users were told what to do. The question is whether the product remains acceptably safe when predictable human behaviour and ordinary environmental realities are taken into account.
What the Tread+ Case Reveals About Red Herrings in Safety Debates
The Peloton Tread+ episode demonstrates a recurring pattern in product-safety controversies. Regulators and critics may ask whether a hazard exists under foreseeable conditions. Companies may respond by stressing instructions, warnings, and proper use.
Those points can be factually correct and still leave the core issue unresolved.
The logical mistake occurs when the discussion shifts from “Is the product adequately safe in the environment where it is expected to be used?” to “Would the injury have happened if every warning had been perfectly followed?” The second question may be easier to answer, but it is not necessarily the question under dispute.
In the Tread+ case, the central safety challenge was that the product was intended for homes, while the reported hazards involved conditions commonly found in homes: children, pets, objects, and momentary lapses in control. The controversy therefore became a test of whether warnings alone could answer concerns about foreseeable use.
